The legal system and its processes are littered with twists and turns, and ups and downs. Our complaint against the HOA’s Board of Directors and three past and present officers has encountered a legal inconsistency, commonly referred to as a technicality.
Because of this defect in the law, we have been advised by legal counsel to withdraw our complaint and have agreed with the defendants to walk away. There are no damages, penalties, or stipulations for either party.
The intent of our lawsuit has always been to rid our community of corruption, and we are saddened by our inability to continue. It is unfortunate that we were not able to see this action through to its rightful conclusion, which we were certain, was in the best interest of this community.
It is indeed a miscarriage of justice that a clerical error prevents individuals from being held accountable for the damage they have caused, and continue to cause, our community.
By bringing the suit, we were not seeking personal enrichment or compensation. We gained notoriety through the shameful acts of others, who sought to personally gain from their frequent demeaning public announcements and written opinions, not intended to inform, but to humiliate.
We will continue to keep a watchful eye on our community as special interests seek to change its complexion and transform our home into something it was never intended to be. They seek to change our community into their vision, a vision not shared by many.
We will not hesitate to act, as we have done in the past, if the situation warrants, and we have the legal authority to do so.
