A Rebuttal....

1. A lawsuit has been filed against the Association in order to shine a bright light on the unlawful behavior of the Association in the present and over several years.  We are not seeking to intimidate anyone and certainly haven't sued "every homeowner in the Plantation."  We encourage you to read the complaint for yourselves rather than trust any individual homeowner's opinion -- regardless of who that might be.  


2. A member of the LLC Board has asserted that: "It costs less to keep the courses than it will to close them" is absolutely FALSE. Please review the Association financials for yourselves and you will see that were the golf courses converted into a conservation area/nature trail, the $1M+ we spend each year on the courses' maintenance would no longer be part of the assessment we all pay.


Yes, there will be landscaping costs to maintain the conservation area/nature trail, but these costs will come in at a fraction of what we all are paying now to maintain the golf courses. In addition to that immediate savings, we would no longer incur the never ending special assessments that have been levied on us all to support the golf courses -- whether we golf or not (and, importantly, only a small minority of the homeowners in The Plantation regularly play the courses).  Please ask yourself: why should a small minority of homeowners in The Plantation get a free ride on the rest of our backs? This is America: if they wish to retain the golf course, they can establish a private club, pay all the expenses, do their best to recruit new members, and take a shot at it -- just like the other private club owners have done in the past. But why should the overwhelming majority of homeowners pay to subsidize the lifestyle of a small minority?


3. Many older, fixed-income homeowners in this community have been and continue to be hurt by the never-ending special assessments and now proposed increased annual assessments.  The response from our leadership? "Well, they need to move if they can't afford to live here." Is that fair? Is that even moral?


On what planet is it proper behavior for homeowners to be dispossessed of their homes so that the wealthier homeowners in The Plantation -- that is, those who can afford to maintain an active golf course lifestyle -- continue to receive a handout from the rest of us??


Anyway, those are the reasons a lawsuit has been filed. We have faith in our judicial system and are fully confident justice will prevail.
